Legal Question in Family Law in West Virginia

separation

I am curious what I would be entitled to after being with someone for five years and two children. I want to leave but he says that I can not take my kids or the car. I am allowed to take my clothes and that is it. Is there a law saying that I can not take my car (it is in his name.) or my children? we are not married and I have stayed home since the first child was born. I just need to know that if i do leave can this come back on me later in court? I mean he wants me to leave and only get the kids when he allows and wants me to walk to leave. I just think that it is mean and demeaning but I need to know my rights and some of the laws pretaining to my situation. So that I can make the right decision. He says that if i do leave he will report the car stolen and I do not want to leave for fear of that. Please respond as soon as possible. thank you for your time. I appreciate it.

Re: separation

Washington recognizes the need to be able to dissolve a non-marital relationship. All of the issues that exist in dissolution of marriage exist in dissolution of meretricious relationships: parenting plans, child support, property distribution, debt distribution. The court has some discretion to determine what is fair. The details of the situation will determine the details of the outcome.
