Legal Question in Family Law in West Virginia

Uncontested Divorce

If someone in this state wants a divorce and you want it also. Do one or more parties need to show up in court? I was told that neither party has to show up, Is this legal or not? Also how long will it take for them to send me a copy of the divorce. Thanks.

Re: Uncontested Divorce

Only the Petitioner (the one filing the divorce) needs to be present at the final hearing in Court. At the time of the divorce a certified copy can be made at that time. Request at least 2 or 3 copies so that the Respondent can also get the divorce mailed by the Petitioner.
