Waive a Physician form, Help My Brother!

My brother is 28 years old and has some mental disabilites. The payee on his Soc. Sec. check has not used his money for him. He is now homeless, has had his utilites shut off, has no transporation, no winter clothing, has not seen his physician since 2002....in other words she has done nothing except, well who knows what, with his money. I am now trying to file a petition to become his guardian and conservator, my problem is that a physician form is part of this petition. He has refused to see a doctor for me, how do I file this, how do I get the court to waive that form?

Please help in this matter, my brother's health is now at stake.

You cannot get the court to waive the Doctor's Declaration. The best thing you can do here is to get your brother to go with you into the Social Security office and have you put on as payee for the Social Security check.
