Legal Question in Civil Litigation in West Virginia

Embezzlement

I was forced to resign(fired) from my job for selling and keeping money some where around $2000 dollars. My question is it has been 16 months later and they want me to repay almost a thousand more than i owe them and pay interest on it.It had been almost 14 months before i was contacted and now they are threatning legal action if i don't start repaying it. Is there a statute on how long they have to file charges? Can they charge interest on the money? Is there any legal action they can take at this time?

Re: Embezzlement

... for selling WHAT ? I think you left a word out.

The 16 months is nowhere near the statute of limitations in MY state, I can't be sure of what it is in YOUR state, but I seriously doubt they've run out of time in 16 months!

They should not be asking for an extra thousand and you should notify them of that if you're willing to admit you owe them the $2,000; I wonder if that's a trick on their part to get you to admit to what you owe, or if someone else embezzled the rest! A court might award interest and it's not inappropriate for them to ask for it, but you don't necessarily have to pay it and could probably try to negotiate that away in exchange for a promise of swift repayment of the rest, but you will almost definitely need a lawyer for that negotiation to keep yourself out of big trouble, possibly jail! Statements you make could be used against you in ways you'd rather not have happen.

Yes, there are several legal claims they could bring. Embezzlement is one! Larceny might be another angle on it.

I urge you to hire an attorney. Good luck.
