Legal Question in Civil Litigation in West Virginia
I am a paralegal working on a defense case. I accidently sent a letter to a doctor's office requesting depo dates. Within 20 minutes of the fax I realized the doctor was disclosed has an expert for the plaintiff. I immediately contacted the office cancelling the letter and telling them that I sent it in error. I never spoke to the doctor. Have I cleared myself from this mistake? I have been a paralegal for 18 years. I just wasn't thinking.

Probably. But you should tell the lawyer you're working for what happened right away. If you're working directly for the client, tell him or her. They need to know about it, since you were working as their agent. If the other side brings up the issue, the lawyer or client should not be taken by surprise.
