Legal Question in Landlord & Tenant Law in West Virginia

help i am being evicted

My husband and i live in our trailer on my father-in-laws property rent free. recently after I called the police to my home on a friday evening because i was being shot at by another tenant on property, i was told by my fatherinlaw that i would be evicted if the law came. they did and on the following monday he filed paperwork at the magistrates office for us to be evicted. The case was thrown out of court for improperly being filed. Now the father-in-law has sent us a written notice and intends to file suit after the time in the notice if we arent out. My husband and i are not working because i have cancer and he has COPD we have filed with the state for assistance and have no other income. local trailer lots have restrictions will not allow our trailer due to its age and size. my husband has always lived here and still has free run of the home he grew up in (entering as if it was his) What can we do? We can't afford the move and my husband feels this has and will always be his home.

Re: help i am being evicted

You better get a poverty attorney in your county to assist you because you are one document away from being homeless.WIthout an agreement for rent you could be evicted for paying less than "fair rent value" for the lot. Your best chance is coming up with an agreement with the property owner ASAP since he holds the cards right now.Call your local LEGAL AID or Welfare office.
