Legal Question in Legal Malpractice in West Virginia

When bar ask's attorney to respond to charges,

After sending complaint to the bar, bar sent charges to attorney and attorney responded that he will not respond to charges because he is in litigation with us in civil court for fee dispute. This case has a date set for court in Oct of 2008. Can he refuse to answer the bar for a year? This tells us that any attorney who knowingly does unethical things can just sue his client then plead that it is in litigation, push court and mediation dates as far up as he can and he does not have to answer the charges. I did counter sue concerning his civil complaint. Mediation has been set for 8 months from now. This just seems absurd. I have to answer his response to the bar within 10 days. How can I respond to the bar to have them push him to respond?
