Legal Question in Personal Injury in West Virginia

Insurance Medical Payment

My daughter and I were involved in a car accident a little over a month ago. The accident was caused by road conditions in which I lost control and hit a tree, no other cars were involved. We both were treated at the local hospital. My insurance company says that my policy has a $3000 medical coverage per person per accident. My question is... am I entitled to the $3000 for each of us or only what is necessary to cover medical bills. My insurance says only medical bills. Please advise!

Re: Insurance Medical Payment

Your automobile coverage includes both the Medical Payments limits applicable to each passenger as well as a liability coverage limit applicable to the claim of each passenger. You should consult a lawyer about your situation. Your case is a fee generating case and there should be no fee for the consultation. My discussion of your coverages is necessarily made on assumptions and cannot be taken as legal advice. Any lawyer would want to interview you, and look at the accident report as well as the policy and the Declarations Page from the policy which shows the premium charges and the coverage limits.
