Legal Question in Personal Injury in West Virginia

scarring settlements

i was in a single car accident as a passenger

in which the driver was found 100% at fault.

I have 2 opinions from plastic surgeons that I have permanent scarring and deformity of right arm and leg.

I have written my own settlement request to the insurance agency asking for the total of the insurance policy which was $300,000.

Do I need to ask for more or less money?

What are some other settlement amounts for injuries such as this?

Without a lawyer you will be lucky to get 5% of that amount. A lawyer familiar with your local courts can advise you on what your claim is worth, and should be able to settle for an appropriate amount. Without a lawyer, the insurance co. knows (a) you can't sue; and (b) you have no idea what your claim is worth. They have professional adjusters trained to take advantage of you. Level the playing field and get a lawyer.

I agree with Mr. Press - get a lawyer to represent and advise you. In addition to the reasons he gave, know that some states may not compensate scarring. My state, RI, did not do so until a few years ago. Also, if your case has a value over $300,000, your attorney may make a claim under YOUR insurance policy pursuant to your underinsurance provisions. He or she can tell if that option is available to you. Good luck. -- Bob
