Legal Question in Personal Injury in West Virginia

Sexual Assault of Grandaughter at Target Dept. Store

My grandaughter was sexually assaulted in a Target Dept. Store in S. Charleston, WV, while shopping with her mother (my daughter) on July 13, 2003. Do you feel my daughter and granddaughter would require legal representation regarding any of the various aspects relating to this matter. My daughter is a hard-working (2 jobs)single mother of two daughters, ages 11 and 12. I advised my daughter to retain legal counsel AS SOON AS POSSIBLE; however, she is only conerned with the welfare of her family at this time. Do you agree that she should retain counsel NOW and not wait? Can you offer any recommendations? Thank you!

Re: Sexual Assault of Grandaughter at Target Dept. Store

The parents or guardian of the minor child should consult counsel prior to discussing the matter with store employees or the insurance company representative. Also, it is important to evaluate what evidence and what statements must be preserved or important information may be lost. Most personal injury lawyers will meet with you at no charge and discuss what the legalities are and what you may expect. You may elect then or at a later date to retain counsel. Thus, you may consult more than one PI lawyer to make an evaluation prior to hiring one. Your case seems to be one that would be handled on a contingency basis, that is, no fee until there is a recovery. Tom Zimmerman
