Legal Question in Real Estate Law in West Virginia

Binding contract

I own a mobile home and only signed a piece of paper stating that I would sell my mobile home for $8,000 to so and so. She said she needed this statement to take to her loan officer (2 mos ago). I now have a cash offer and she says he will take me to court if I sell it because we have a contract that I will sell it to her. It is two sentences stating that I will sell the mobile home to her for $8,000. Is this a contract meaning I can't sell to anyone else......it's been two months and she keeps me hanging on. Help!!!!!!!!!!

Re: Binding contract

Two months is probably too long, but I don't practice in WV so check with a local attorney; it is worth the few bucks to make $8,000. If the written agreement doesn't give a sale date, then you are only required to wait a reasonable amount of time. To be safe, give her a written notice that she will have to pay you the same amount in cash before the other party does and schedule the sale. This way she'll have an even weaker case against you if she did try to sue you.
