Legal Question in Real Estate Law in West Virginia
Lousy neighbors are keeping me from my land....
I placed a contract to purchase a piece of property from my former
employer. I paid $5000 as a down payment,to be owner financed per a
written contract. When the closing date passed, they asked me to extend
the term. It was not altered in its written form, but the extension was
witnessed and the owners consistently referred to the property as
belonging to me...(his lot, his property, etc). I also made substantial
improvements on the lot ($30K), based on their promise to sell it.
I had a dispute with adjacentowners, following my denial of their use of
MY property to ride their horses. They made a statement to another
owner that ''they intended to keep me from purchasing the property.''
The owners (my former employers) let me go in June, and denied me the
right to their contracted ''owner financing'', instead, demanding
immediate payment in full for the property. Following my inability to
close, they kept my deposit, despite a clause stating that it would be
refunded ''in the absence of financing''.
The owners ''let me go'' so they would not face any ''potential lawsuits''
from the neighbors.
Do I have recourse under any form of tort? (interference with contract?)
