Legal Question in Real Estate Law in West Virginia

Mobile Home being moved next to my home

I have a mobile home being moved about 100' from my front porch. They will be building a garage right next to my property line which will be about 50 feet from my front porch. My home appraises at about 130,000.00. If this mobile home is moved here it will hurt the value of my home not to mention that it will be nearly on top of me. I will have no privacy. The people putting the mobile home there don't own the property. The property belongs to their family members. They will be tapping into the same water line I use so therefore my water presure will not be sufficient. I own my home and property. Is there anything I can do to stop this?

Re: Mobile Home being moved next to my home

The basic rule is that one may use his property as he or she sees fit as long at it is lawful and does not create a nuisance. A lot more needs to be known about your situation to advise of possible remedies. I presume there is no zoning. The first option may be to buy one or more of the owners out and thereafter bring a partition suit to buy the whole tract. The issue of the water can probably be evaluated with a review of all the deeds. You should see a lawyer and go over the whole circumstances. Tom Zimmerman
