Legal Question in Real Estate Law in West Virginia
Right of survivorship
My brother passed away. We had a piece of property deeded to us as tenants in common with right of survivorship. Need I do anything at this point to assure my ownership of the porperty?
I live in a different state from the porperty.

Re: Right of survivorship
If you and your late brother owned the property as tenants in common, then you only have a one half interest in the property -- there is no right of survivorship with a tenancy in common. If you were joint tenants, you would have a right of survivorship. You'd better determine which situation applies to you before you do anything else.
