Legal Question in Tax Law in West Virginia
Looking for inheritance tax code
When my father passed away, I was named executer of the estate. I was told by my lawyer, who wil not return my calls now, that I did not have to pay taxes unless my share exceeded $500, 000.00. That was in the year 2000. So, I did not claim that money on my taxes. IRS has sent me a CP2000 form asking me to explain this. When I called, they said that all I needed to do was find the code and law that states this, and send it to them in writing. Could you tell me what code it is, or tell me how to find it on the internet?

The filing requirement for a federal estate tax return is not based on how much each heir gets (as your question implies), but on the amount of the decedent's "gross estate." Your starting point for educating yourself about this should be IRS Publication 950, which you can find on the IRS website at www.irs.gov/pub/irs-pdf/p950.pdf.
