Legal Question in Wills and Trusts in West Virginia

Missing Estate Money

My grandma passed away about twelve years ago leaving my uncle as in charge of her estate. Each of her 3 children (one being my Dad), were to receive 3 equal amounts as well as each grandchild to receive a set stated amount.

10 days after my Grandma passed away, my Dad died unexpectedly of a heart attack. My siblings and I each received the stated amount that was set aside for each of the grandchildren, but nothing else.

1. Were we entitled to my Dad's portion of what was given to him by my Grandma before he passed away?

2. How do I find out where that money went?

3. Has our time run out after 12 years?

4. Is the will pubic record?

Re: Missing Estate Money

In most cases the heirs of your father should have been entitled to his share. You would have to see the Will to be absolutly sure of that. The Will and most probate documents are public record and are available from the probate court. Call the court in the county your grandmother lived in to order or view copies. Your 12 year wait is a big problem but it is possible the probate was never closed or the funds were to be held in trust for you until you reach a certain age.
