Legal Question in Wills and Trusts in West Virginia

Pension

My grandfather recently passed away. He was living alone but still married to my grandmother. She is the beneficiary of the remainder of his pension. My mother is the executor of his estate. She needs to know the amount my grandmother is going to receive so she can turn it into the state. My grandmother will not cooperate. She refuses to give my mother an amount. What can we do?

Re: Pension

As the executrix of the estate your mother is entitled to the information from the employer or Plan Administrator. If necessary, she could bring an action and subpoena the information. Usually a letter with a copy of the Certificate of Appointment is sufficient.
