Time Limit on Excuting Will ?

I am trying to find out if my mother and aunts have any rights. My grand father died over 22 yrs ago and my grandmother died 2 months ago.

My uncle who excutor of my gfathers will is now trying to excute my grandfathers will. Can he do this now or should it have been done years ago.

Re: Time Limit on Excuting Will ?

In West Virginia there is a statute which makes it a misdemeanor to hold a will beyond 30 days, but there is no time limit to present the will. You should get a copy of the will and take it to your lawyers office. Since your grandfather died first, his assets, what is left of them will pass according to the will. If your grandmother died without a will, then her children are her heirs at law.
