Legal Question in Appeals and Writs in Wisconsin

My friend just got an underage drinking ticket. She turns 21 in a month (october) and her court date isn't until late november. We heard that if you turn 21 before your court date the ticket will be dropped. Is this true?

Prosecutors can always dismiss cases as a matter of discretion. I'm not aware of any law requiring pending underage drinking cases to be dismissed when someone "ages out" of the violation, but I too have had this happen for clients whom I represented. Courts with such policies obviously have better things to do with their time that to prosecute 21 year olds for underage drinking if they turn 18 before they need to appear court. I would certainly agree such policies. You need to speak with an attorney who routinely practices before your specific court where this ticket is pending, since policies vary throughout the state, and this probably does not happen automatically if you just ignore the ticket.
