Sending personal account info to another unautherised address

I have not gotten banking statements and or recieved info on my banking status for quite sometime. Unaware that my one of my accounts has fallen behind I am now to appear in court for the payment. I found out recently that a girl friend of mine who banks at the same place but doesn't share an account with me has been getting my letters from the bank sent to her house. Can I use this as a defense and if so is it covered by just state law or is it federal as well.

Is she a signatory on the account?

Did the bank receive a change of address notice?

You may have a defense but need to subpoena the bank records and notices.
