bankruptcy failure

i have filed a chapter 7 and a dept of 40 thousand was left out??. shocked is not the word but the bottom line is can i file again? i realy need to get red of this debt as the amount was half of what i owed in the first place. my attorney said there was a mistake???? well i guess. i am at a total loss at this point can i bring leagle action on my attorney?? please help. i don't want to go back to that attorney again i can live without that kind of guidance. i very much appreciate your time in this matter. thank you.

I can't give a certain answer to your question without more facts. If the error was yours, and you forgot to tell the attorney about that debt, there is likely nothing you can do. On the other hand, if the debt was not included because the lawyer made an error, then you still may not be able to remove the debt, but you could possibily recover your loss against the lawyer or his/her insurance.
