Legal Question in Bankruptcy in Wisconsin

I had filed bankruptcy around August of 1996. In December of 2002, a circuit judge granted a repayment schedule under Wisconsin statute 128.21 in which a trustee was appointed for me. Since then I've accumulated many medical and other bills that were not included in the the repayment schedule and I am two months behind in many of my bills including the repayment plan. Plus,I am due to start paying off my student loan in the next coming year or two (economic hardship). My question am I able to file banruptcy at this time and does it matter that a judge okayed a repayment.

Hello, usually I can come up with some general observations about questions posted on here. You facts and the law in this area are too complex to make any further commentary. Your choices are either to hire an attorney to find out the details of your situation and advise you, or to file yourself and find out what the trustee says. In fact, you say that a trustee was appointed. Ask the trustee what your options are. You are not asking for legal advice, just to find out what your situation is now under the existing plan.
