Legal Question in Bankruptcy in Wisconsin

I have a Chapter 7 Bankruptcy that was discharged in 2005. Am I able to file bankruptcy again, and, if so, when? State of Discharge was MN and now reside in WI. Thanks

Eight years is the current waiting period between chapter 7 filings, with a few exceptions. Although you need to have this verified by a bankruptcy lawyer, who will have access to the court's electronic database in order to verify your past filing dates, you can probably file again in 2013 on the eighth anniversary of your last filing. However, if pressure from creditors makes it impossible to wait, you also have the option to file chapter 13 at any time and receive at least some protection from your creditors, and even receive a new discharge, 4-6 years after your last chapter 7. Like most bankruptcy questions, this one has no simple answers. It is therefore critical that you consult as soon as possible with an experienced bankruptcy lawyer if you wish to protect yourself from your creditors.
