Failing to pay damages from any type of uninsured accident can cause loss of your drivers license in WI. Unless you have liability insurance which pays the victim for you, the damages stemming from an accident while driving drunk are not dischargeable in a chapter 7 bankruptcy (which would normally take care of the problem for a non drunk driving accident). However, a chapter 13 bankruptcy can prevent revocation of your license while you are paying off the damages (even for a drunk driving accident) over a five year period, assuming that you pay as promised in your chapter 13 plan and that your plan is approved by the court. Quick success is most likely if you file the chapter 13 bankruptcy before the revocation of your license occurs; afterward it may involve more red tape and litigation before you can reinstate. I would therefore recommend that you promptly have a consultation with an experienced bankruptcy attorney. Other than advising you to immediately get a lawyer, my comments here do not constitute legal advice and do not create an attorney/client relationship between. However, you are more than welcome to contact me via my direct email address posted here or by phone in order to discuss arrangements for me to possibly accept your case for full representation.
