Legal Question in Bankruptcy in Wisconsin

If I've not yet filed for bankruptcy, can I stop paying my monthly credit card debts without severe consequences? I was told I could be sued? For what? Also, once I file, how long does it take for bankruptcy to be in effect?

Yes, you certainly can be sued if you stop paying your credit cards before your bankruptcy is officially filed with the federal bankruptcy court. However, if you are well organized and your case is not too complex, any good bankruptcy lawyer should be able to accomplish that filing before these lawsuits heat up. Therefore, although it may be unethical for your attorney to tell you to stop paying your just debts, it is proper for your attorney to advise you that you need to prioritize your own household expenses, including payments on debt. In the great scheme of things, one or two more monthly installment payments on a debt which his headed for total forgiveness via bankruptcy discharge may not matter as much as whether or not your family has avoids becoming homeless and has enough to eat. You therefore need to make the decision on your own whether or not to continue your payments on credit cards pending your bankruptcy filing.
