My 28-year-old son lost a very good job. His employer would not pay for his depression meds, as it was a former disease, so my son went off them and had a major breakdown and lost his job. He now owes about $80,000 to debters and is having great difficulty finding another job. We are trying to get him help through our county. Can he file bankruptcy? Thank you.

Bankruptcy Dischargeability of Debts Incured Due to Mental Illness and Job Loss
Medical bills are generally dischargeable in bankruptcy, as are debts incurred in good faith which go unpaid due to job loss which was beyond a debtor�s control. Voluntarily going off psychotropic medications, however, might not be totally the fault of the rest of the world--your son bears ultimate responsibility. Even if a person is unemployed, essential medications should remain a priority if needed for one's functioning. If one loses health insurance, he or she should discuss the problem with their doctor to inquire whether or not cheaper generic medications might also help them, even if less than ideal. Sometimes doctors also have sufficient free samples to last until the patient can get back on their feet.
