Legal Question in Bankruptcy in Wisconsin

Ex Husband Bankruptcy on My Credit Report

I divorced in 1992. The decree included a consumer loan that was assigned for payment to my ex. He refused to pay. 4 years later he filed bankruptcy; debt was discharged.. Neither he nor the creditor notified me. The debt was turned over to a collection agency. I first found out when it showed up on my credit report. Now, the creditor has placed the bankruptcy on my credit report, in addition to the collection action. Trans Union refuses to remove either action. I have NEVER declared bankruptcy; have immaculate credit except for this blight. I understand I may be liable for the consumer loan, but how can I get my ex's bankrupcty off my credit report? Who can I appeal to?

Ex's Bankruptcy on Your Credit Report

What you need to do is to sue Trans Union. Iwould suggest you get a credit report fromEquifax and one from TRW to see whether yourex's bankruptcy appears on their reports, too.If it does, you will want to sue Equifax and TRWin the same lawsuit.

To find a lawyer in your area who can handle thelitigation, go to http://www.wld.com and do asearch under Concumer Law in your locality. If you cannot find someone, try http://www.martindale.comand do the same sort of search.

Your suit will be brought in Federal Court andyour attorney can obtain an injunction, moneydamages and attorney fees. The action will be filedunder Title 15 United States Code Sec. 1692.
