Legal Question in Bankruptcy in Wisconsin
if my landlord is filing chapter 7 bancruptcy do i have to pay him rent
1 Answer from Attorneys
Bankruptcy does not necessarily reject all contracts of the debtor. This means that the debtor (including your landlord) or his bankruptcy trustee, would have the option to accept the rental contract with you even after bankruptcy. This leaves your landlord or his legal representative with the usual range of options including evicting you if you do not pay the rent. Therefore, if your landlord demands rent and you fail to pay it, you probably face eviction if your landlord pursues that option, meaning that the answer to your question would be yes. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you are welcome to contact my office to discuss retaining me or to set up a free initial consultation at my office in Racine. I also can sometimes arrange to travel outside of Racine for initial consultations if absolutely necessary.
