reaffirmation agreement
I am helping my son file for bankruptcy. We are doing a reaffirmation agreement. Is this filed with the petition? Can he ask for a reduced interest rate? What is redeeming collateral under section 722 of the bankruptcy code?

I am unable to advise you on a pro se filing, but the processing of a reaffirmation is normally handled by the creditor. Your son should really seek some legal advice prior to reaffirming because such agreements are normally not in a debtor's best interest. Obtaining such limited services should be far less expensive than hiring an attorney for full representation in a bankruptcy. Reaffirmations are always negotiable, although choices may be limited. Redemption of collateral means paying the creditor the full value of the collateral in cash. A procedure exists wherein the court can determine the value if one is not able to reach an agreement with the creditor.
