Legal Question in Bankruptcy in Wisconsin
Student loans and bankruptcy
A gal I know is having trouble getting her life together. She received a degree with the use of a student loan. She is a recently recovering alcoholic. Her loan was for 13,000 but penalties and interest equal approximately 21,000. She makes approximately 18,000 per year, no benefits. Rent is 500 per month. She would like to get out of this exteme dept. Is there any way she can get out of the loan thru bankruptcy. Thank you

Re: Student loans and bankruptcy
Student loans can be discharged upon a showing of "hardship"
or if they are more than seven years in pay status, not
counting any deferments or grace periods. Proving
hardship can be difficult and expensive depending upon
which federal circuit she is in. She should consult
with any attorney with extensive experience in bankruptcy.
