Legal Question in Business Law in Wisconsin

Breech of Contract

Hi, I own and operate a DJ company in which we have a contract which says that ''Payment must be received at least 10 days prior to the performance.'' If the wedding party claims that they ''will not comply with that rule, and pay us after the performance, what sort of legal recourse do I have? If I do not show up for the performance after warning them this is what will happen, I am still ok legally because they breeched the contract correct? Thank you for your help.

Re: Breech of Contract

It is of course impossible to say without actually seeing the contract, but the bigger question is why would you want to do this?

Do you think that you will not be paid? Are you willing to ruin someone's wedding over a disagreement about when you are paid? Not showing will certainly guarantee that you will not be paid?

Also, was it clear that these payments had to be made in advance?

Who signed the contract?

All of these things need to be considered, but I would think that the negative recommendation that you would receive for doing this would far outweigh the "principal" of the thing when it comes to when you get paid.

Good luck
