contractor never got paid from owner. as a subcontractor can i sue the contractor for the money?

Look first to any formal documentation you have that describes your relationship with the contractor. If some exist then they will likely cover this issue head on. If none exist, then your options vary greatly depending upon other facts surrounding this project. For example: (1) have your verified the homeowner did not pay or is it possible the contractor took the money; (2) what did the contract between homeowner and contracts state as to payment terms, indemnification, etc. (3) why is the contractor not pursuing the money owed by the homeowner, etc. etc. etc. Unfortunately there are far too many facts missing for a knowledgeable lawyer to provide the appropropriate answer to your question.
Depending upon the amount of money owed, you would likely be greatly served in discussing the details of your matter directly with a lawyer. Gather all the documentation you have and give us a call.
