Banishment
Native American Reservations are turning to banishment as legal punishment? Must this procedure be first dealt with in a court of law before Tribal Councils and/or Legislature act on such procedures.

Although I do not have an answer based upon any legal research, my first thought is that the Tribal Courts would have the jurisdiction to deal with the issue.
