Re: confiding in a lawyer
There are several situations, basically, when you say you're about to commit a crime, when other people are present such that the privilege is deemed waived, and some other situations. When in doubt, ask your lawyer.
Re: confiding in a lawyer
When a 3rd party is present to whom no privilege attaches, the information is not privileged. For instance, there is a husband-wife privilege so if the discussion with the attorney has the wife or husband in attendance, the information is still privileged. However, if you have a conversation with an attorney and a friend is there, the information is not protected. There may be some instances where an attorney has to report information s/he obtains from a client but my above example is the most common in civil litigation.
