I would first contact the police to file a report and have them determine what law enforcement agency should investigate. If the police are of not help, then I would contact the county District Attorney's Office to report this to them and obtain assistance. Depending upon how long ago this happened, I would consider having a medical exam done to document any injuries, etc. I this happened in the Stat of Wisconsin, then there are certain notice requirements which need to be complied with. If this was a city or county jail, a Notice of Injury form should be filed, within 120 days of the date of the incident, with the clerk for the City or County (depending on who ran the jail), per Section 893.80, Wisconsin Statutes. If this was a State run institution or with State employees, then a notice needs to be sent by certified mail, within 120 days from the date of the incident, to the State Attorney General's office, per Section 893.82, Wisconsin Statutes. I would recommend that you and/or your husband consult with an attorney as to his rights to pursue the claims.
