Using a published point scoring system in software I sell

I have programmed computer software that uses a published hand scoring system for a poker game (omaha Hi Lo). The scoring system was first published in a magazine, now on a website of the author. It is the Hutchinson system. Is it legal for me to sell software that uses his system. The software does not mention him, but the outputs of the software would match his same hand scoring system.

My software also bases what to do with your score differently than Hutchinson does, I add for position and table aggression.

If this is not legal for me to use without permission. How much would I have to change it to make it legal? Could I just double all the numbers, or would I have to add ''new'' logic?

If it is legal am I allowed to use his name in promoting this product?
