Legal Question in Constitutional Law in Wisconsin
Can an employer require you to sign the united way form and if you do not can they punish or write you up for not signing the form? Is this legal for them to require you to sign the form whether you donate or not?
1 Answer from Attorneys
It may or may not be legal to make you to sign a form, depending upon what the form says. While it may not be legal to force you to make a charitable contribution, they could always find some other reason to fire you if you don't do what they want, unless you have some sort of an employment contract or collective bargaining agreement that protects you from termination for such reasons. If the form simply says that have received certain information, it would not appear to violate any constitutional rights that I know of, although forcing a contribution might be a breach of your first amendment freedoms. You should repost this question under employment law if you want more answers, since forcing you to sign a form acknowledging receipt of information is not a constitutional issue,.
