Question is travel ban. Is the past a matter of legality as before Trump was & now is President.?

Yes. Although I don't understand your question, the past is always considered by the legal system, and Trump being President did not change that. The travel ban, is being attacked on constitutional grounds of equal protection and due process, which litigation does consider the past case law decisions in these areas, in determining whether the rights of minorities are being violated, and can be struck down by the courts if so.
