Legal Question in Construction Law in Wisconsin

Modular Home Not Built To Specifications

I started with a manufactured home plan, but the company couldn't find any comparisons for the loan process. The company then decided to build a modular home and have it built to the same specifications as the other. I have a signed plan from the manufacturer agreeing it would be built to the same specs. Some parts of the house were not. Do I have a right to a have a new home built to the specs agreed upon or some sort of discount off the price of the home?

Re: Modular Home Not Built To Specifications

Hello,

You should get a warranty under Wisconsin law. I doubt if you get a new home, but you should be able to be compensated for any losses. However, these cases are always complex, and your position is impossible to assess without more facts. There are a number of statutes in Wisconsin that apply to these cases that should help you out.

good luck, Mark J. Mahoney
