Legal Question in Consumer Law in Wisconsin
checking account withdrawals
What type of security or rights do I have against a company that continues to make withdrawals out of my checking account even with a contract that says you can withdraw the monthly payments

Stopping Automatic Checking Account ACH Withdrawals
ACH or "automatic clearing house" withdrawals can be extremely difficult to stop once they are set up. The best policy therefore is probably to never set up ACH withdrawals in the first place. Instead, many consumers now set up automated online payments, over which they continue to enjoy full control, unlike the ACH withdrawals, which can be irrevocable. If clients cannot get either the bank or the merchant to stop the ACH withdrawals voluntarily (which may require the sending of many certified letters and many phonecalls), I advise them to close the account after paying all fees due on it and start over at a different bank or credit union. If your ACH withdrawal settup required you to submit a blank, voided check, you might also attempt a "stop payment" order on that check number through your bank's customer service department. Good luck!
