Collection Agencies
My husband lost his job and our credit card company, Capital One, turned our accounts over to collections. We called them to try to make arrangements, and were told what our payments would be. They had our bankcard number and took money out of our account without our authorization. We called Capital One back right away and in the course of the coversation found out that we were actually talking to the collection agency all along and we just were never told that. They intentionally misled us, because when my husband talked to them he brought up the fact that we were being plagued by the collection agency. Apparently when you are in collections and you call your creditor and key in your account number you are automatically transferred to the collection agency without your knowledge. Is this legal? Thanks for your help.

What you have described sounds like a clear violation of the Federal Fair Debt Collection Practices Act. You may have a lawsuit against THEM.
