Contract Disagreement
If a photographer offers a package with an engagement session included and fails to appear on the set date, is the customer entitled to a refund of the retainer fee? Did the photographer breech the contract?

Absolutely. Unless there was a written agreement which made the deposit non-refundable in any circumstance. If no written agreement, you should obtain a new photographer and demand a refund.
