Legal Question in Consumer Law in Wisconsin
DirecTv
We have had directv for about 6yrs now, without a problem. In March we mioved and called to have our sevice ended. We got the speech of ''If you stay with us, we will move your service and give you a discount of $10 a month'' We went with it, but for 3 months we never saw the discount and we tried calling and emailing Directv without ever once a call back. Not until I filed a notice with the Better Business Bureau did they call. I told them I would like my bill credited and I would like to cancel my service since they showed very poor customer service to me. The lady emailed and said I could cancel, but it would be a $250 early termination fee. My question is, can I get out of that fee since I feel they breeched the contract by not giving us our discount for 3 months and then not returning calls or emails? Thank you!

Fraudulant Representations to Consumer
The problem with this and all consumer services complaints is that asserting one's rights will often costs much more than simply paying the bill. If you are willing to stand up for your rights and pay the expenses of litigating the matter, there are excellent remedies available for consumers victimized by false representations, including double damages and reimbursement for attorney fees. However, you must be able to prove the lie--who said, when, and under what circumstances, as well as any conditions upon which the promise was to be based--difficult without a tape recording. They vendor might deny that any such promise was made, placing you in a "swearing match" with them and creating much uncertainty as to who the judge will believe. Good luck!
