Legal Question in Consumer Law in Wisconsin

I fell for a telemarketing vacation scam. I gave my credit card information knowing they were going to take $598 as a payment for them sending the vacation package information. I knew the vacation package was going to cost some money, but was a savings. Later I come to find that the whole thing is a scam of sorts and I would end up paying a larger sum for a less than good vacation. The package is through FloridaBahamasCruiseVacations.com Now I can't cancel the vacation, they won't give me my money back, and say I forfiet the $598 if I don't schedule the vacation by December. What can I do to get my money refunded? Am I just screwed out of that money? I don't have any documentation stating I can't cancel. I've tried to explain to them that I can't afford their vacation and I have health problems that make a vacation difficult for me. They say all I can do is forfeit the money or pay more to extend the time to schedule it? I want out!

Your best ally here may be your credit card company. However, you only have 60 days to dispute charges so make sure that you do this as soon as possible. If you can prove to them that it is a scam, they may reverse the charges and they have the legal ability to do that for a short period of time. Therefore you should locate as much information about the vendor/scammer as possible and furnish this to your credit card company as well. You have other options such as sewing the vender, but that may become too expensive to be worthwhile if only over $598. You may, however, be able to add claims for punitive damages in order to make the lawsuit more worthwhile if you can prove fraud or fair trade act violations. You should immediately consult with an experienced civil attorney who handles consumer issues as well.
