Can Plumbers Sue for Costs of an Estimte, Frivolous Suits
Yes, anyone can sue for any reason in WI--there is no advance requirement that the suit be a good one. The mere act of suing, however, does not mean winning in court, and, if the suit is frivolous, the loser might even be forced to pay attorney fees and damages to the winner. The legal term "frivolous" means that it was brought merely for purposes of harrasment, with no legal basis. A home visit by a skilled tradesman such as a plumer, however, can form a valid basis for a lawsuit, depending upon the value of the services provided and the terms of any contract which is either negotiated or implied by law. In order to avoid misunderstandings, it is prudent for a homeowner to inquire in advance about fees any any time that the homeowner requests an estimate.
