Legal Question in Consumer Law in Wisconsin

Who is liable for damage to car motor?

I replaced a radiator hose on my car & immediately drove 3 blocks to a "fast lube place" for an oil change. I asked them to check the coolant level, which is part of their normal service. I rec'd the car after service, the receipt states that the coolant was checked. I drove 25-30 mi. & car overheated & seized up. I went back to the shop & tech admitted he forgot to check coolant level. The station is only willing to pay for 1/2 of the expenses b/c I drove car 3 blocks. Who is liable for repairs? What protocol do I follow to get them to pay?

Re: Who is liable for damage to car motor?

Only a court can decide definitively who is

liable for your repairs. This, however, is

a very expensive way to find out. If you wish to avoid

the expense of the litigation system, you may

wish to negotiate a settlement without going

to court. Only you can decide whether the

offer makes more sense for you than going to

court, after you've wieghed all the pros and cons

including the expense of litigating, which could

easily run over $1,000.00. Feel free to send me

a private e-mail to discuss this further.
