Legal Question in Consumer Law in Wisconsin

Maintenance Agreement Contract

We purchased a stove and refrigerator from Sears and also purchased the maintenance agreement contracts for both. Both contracts are identical except for the item they cover (i.e. stove, refrigerator). We have had some cosmetic issues with the refrigerator (kick plate replaced, door handle replaced, cosmetic trim replaced) with no problems. When we called to get some cosmetic items replaced on the stove, they say these are normal wear and tear items and not covered. The contract specifically states they will replace "cosmetic items". It seems to me to be a double standard.

Re: Maintenance Agreement Contract

I'd sue! On a more serious note, you have

to decide in a circumstance like this whether

litigation to interpret the contract is worth it.

There are some aspects of the consumer act

which allow the recovery of attorney fees if

you are succesful. Send me a private e-mail

if you need more detailed information. Thanks, JKN
