Legal Question in Consumer Law in Wisconsin
Past due bill for item I didn't order
I received a condensed book in the mail which I had not ordered. I opened it to see what it was but didn't read any of the info that came with it b/c I was very busy. It did say somewhere right on the pkg. that it was a ''gift.'' About a month or so later I received another book of the same kind from the same company which I didn't order and didn't want. I just laid it aside b/c I was too busy at the time to decide what to do with it. A few weeks later I received an invoice for about $26.00 for the second book. I finally called the company and was told that there was some form with the first book that I had to send back if I didn't want to receive more books. They told me that if I mail the book back to them, they will cancel the invoice. Am I legally responsible to pay for something mailed to me that I never ordered? And do I have to go to the bother and expense of mailing it back to them?

Re: Past due bill for item I didn't order
No you do not have to pay to return items that you did not order and did not open. You could be perceived as keeping something you did not order but still opened and did not return. If they don't have your credit card information, then they probably won't do anything that can bother you. You should send a letter to them informing then that you do not want them to continue sending unsolicited mail, or you can have an attorney send the letter so they might take it more seriously. You can also report them to the BBB, state Attorney General, federal agencies, etc.
