Legal Question in Consumer Law in Wisconsin
Poll System? Dominos pizza adds 20% to credit card bills.
I ordered a pizza from Dominos pizza. The next day I checked my bank account, and my check card was charged $4.53 more than it was supposed to. I contacted their corporate offices and they said that they use something called the ''poll system'' where they add an extra 20% to credit card bills ''in case'' you'd decide to leave a tip. If not, it reverts back to the original amount. Is this legal? I never authorized them to charge any more than the amount I agreed to pay. Do they have the legal right to do this without explaining this before they do it?

Re: Poll System? Dominos pizza adds 20% to credit card bills.
If Domino's fails to disclose this tipping charge practice, arguably their representations as to the price of the pizza are fraudulent and deceptive, and may be a violation of the state consumer statute governing deceptive representations (Wis. Stats. Section 100.18).
