Legal Question in Consumer Law in Wisconsin
If someone sues you in small claims ct and it is dismissed, can they just sue you again?
1 Answer from Attorneys
Yes, litigants can file any dismissed lawsuit again, and they might even win if you do not defend yourself. However, if the case was dismissed upon its merits or after full litigation of any factual issue, your lawyer can probably get the new case dismissed and possibly even get you additional money if the person filed it frivolously. Rest assured that the law would probably be on your side if you choose to take advantage of it, however, (as opposed to ignoring a new lawsuit). My comments here are not intended as legal advice and do not limit me from representing opposing interests against you (particularly since I do not even know the name of the adverse party. My response here is therefore not intended to create a traditional attorney client relationship, although I would be more than happy to discuss possible representation with you via a private email, phone call or via the inquiry link on my office website.
